ILLOGICAL COMELEC

ILLOGICAL COMELEC

With due respect to Comelec Commissioners Al Pareño, Arthur Lim and Sheriff Abas, YOU ARE ILLOGICAL in your decision by ASSUMING THE DECLARATION MADE BY GRACE POE IN HER 2013 CERTIFICATE OF CANDIDACY (COC) FOR SENATORS was the correct record of her residency.

Did it not occur in the minds of Pareño, Lim and Abas that it was possible that the length of residency stated in the COC for senator was not correct?

How about if Senator Grace Poe made a wrong computation of her length of residence in the Philippine and that mistake was the one she used in writing her period of residency in the COC for Senator in the year 2013?

What would be the implication if the beginning count is wrong?  Is it not that to follow the wrong count would end up the count also in a wrong number?

Suppose that the declaration of Poe about her residency as written by her in the 2013 COC was wrong, will it mean that it was false or it was a misrepresentation for Poe to declare a different number of years and months in her COC for President?

The Comelec Commissioners again opened themselves to the charge of betrayal of the public trust when they did not try to discover if Grace Poe was good or bad in Mathematics. This should be done because knowing how long she had resided in the Philippines is a question of computation or Math.

What then would the logic of commissioners if Senator Grace Poe would say: "Oh my God, I am so sorry I am not good in Math"?

What then is the logic if it turned out that the residence period stated in the 2013 COC for Senator is wrong?

The main interest of the author of this post is justice.  Justice means all about what is “just” as in “service” that is all about what is to serve.  The only element of justice when the issue involves Math is:  “Is the computation correct?”

These commissioners should have read Arsenia B. Garcia vs. Honorable Court of Appeals and the People of the Philippines, G.R. No. 157171, March 14, 2006.
In this case, Arsenia Garcia was convicted by the RTC and the conviction was affirmed by the Court of Appeals because she committed the mistake of computing the votes from the large volume of votes to be collated and computed. Garcia reasoned out it was an honest mistake but the RTC and the CA ruled that the

But the Supreme Court ruled that the mistake in computation made by Arsenia Garcia was an honest mistake and she was acquitted.  From then on until today, the Highest Court decreed that conviction in the charge of misrepresentation as an election offense must be premised on the intention to commit the mistake.
It is then a grave abuse of discretion for Commissioners Pareño, Lim and Abas to use as the benchmark that declaration made in the 2013 certificate of candidacy signed by Senator Grace Poe as to the length of time of her residency.

What the Commissioners should do should be to FIND THE TRUTH AS TO WHEN WAS THE ACTUAL FIRST DAY THAT SHE STARTED HER RESIDENCE IN THE PHILIPPINES?

These commissioners must be disqualified from the Comelec and not Grace Poe from the election for Presidency.
